2. Don't take the original creator's "characters' roles, histories, and conflicts" and change or expand on them, then turn around and demand that no one do the same to you. To do so is arrogant and hypocritical. And definitely don't post it onto the internet, because despite what tumblr may say, posting someone else's words on another website is not a crime, and does not need permission.

So why can't I take professionally publish Harry Potter and put him in Hogwarts, but change the plot from there as long as I give JKR credit? I wouldn't even ask for money on the books. I still wouldn't get away with it.

And yes, it does need permission. Fanfiction in itself actually isn't legal. That's one of the reasons that old "Keep the internet free, fanfiction and fanart is danger because of this bill" thing a while back caused a scare. Most companies just don't after it because of the promotion it can give and the difficulties pursuing everyone.

I'm hoping you'll get it into your head that I mean the copying part. That's why I'm comparing. Not the money part. The part where you take someone else's ideas then throw a hissy fit when they request to be asked first or at least informed.

Already do, sweetpea. What you, however, don't understand is that she does own the plot. All the details posted above. I could care less about the ballet AU part.

You've already been told, mooooooore than once, that your example of professionally publishing something is not the same as posting on a fandom kink meme. Yet you keep using it. Why? It's not the same thing, at all. So why do you keep using it, despite being told you were wrong, over and over?

You've already been told, mooooore than once, that it's hypocritical to cry because someone credited, linked, and quoted someone's idea because they wanted a fic based on it.... yet find no problem with that person using someone else's character and property to write about an AU in the first place.

Because Harry Potter and everything in it (within reason) is the original idea of JK Rowling. The original tumblr poster didn't create the characters she made an AU about. To make this an equivalent comparison, JK Rowling would have had to take someone else's characters, write a book about them, and then sue someone else for writing fanfiction based off her book. That would be stupid, like this whole thing has been.

And no, technically fanfiction isn't legal, which makes your whole position even more ridiculous. By your standards, this AU shouldn't even exist. Again, don't (Illegally!) rip off someone characters, then turn around and have the balls to talk about ownership and permission and work.

I'm not talking about making up the characters or the fact it's ballet. I mean the plot. She had her own fanfiction idea with everything assigned and now someone else wants it done for her. The idea for the plot was stolen.

I'm only bringing up the legalities because people are saying we should have the right to steal whatever we want as long as the characters were taken from an entirely different source. By all of your logic, I should be able to take all the fills on the kink meme, put them on another website, and claim them as my own. Because you stole the original characters and don't have any of the stories copyrighted, you have no reason to get mad at me for doing so by your own logic.

No, people are saying that you don't need permission to say "hey! I like this AU idea that someone else wrote that I credited completely with the idea, I'd like a fill based on that!" Which you don't. Nothing was stolen. Nothing was passed off as the prompters.

The plot is hers and was put here without her knowledge. She found it herself. She even said at the very least, she would have liked to have been informed. That is the point. The plot belongs to her.

Actually, by your logic, I could take the fills. The characters are not yours, you came up with the plot but I want to use it as my own, and it's not copyrighted by you. What's the difference?

She made up a plot by thinking about and expanding someone else's characters and world. What OP is asking, and if a fanfiction writer had written it, would be absolutely no different than what she herself did. No one had anything stolen here, except maybe Himaruya.

Now you're just jumping through logical hoops. If someone reposted everything here, word for word, they would be stealing people's writing. If someone took a fic that was post here, and expanded on it or rewrote the premise, that's not stealing. In fact, that's happened before. And you know what happened? People were happy that others liked their work enough to do that.

You said that people are saying that it's okay to claim someone else's writing as your own. Where has anyone said that? Where did the OP claim it without their own? Again, I'm waiting for that link.

And heck, you have comments up there saying the point is CREDIT. So which is it, anon? credit? Permission?

Also, they asked to be informed AFTER it was posted. They didn't ask prior to it being posted, to saying "but hey didn't ask permission even though the Tumblr user had asked for it!!!" has no weight.
