How old are you? I'm curious. Because you really don't seem to understand the concept of this being FANDOM. This is not that user's COPYRIGHTED CONTENT. You cannot copyright your fandom AU blurb.

I actually studied intellectual property law, so I think I might be able to clear things up. Let's take it apart piece by piece so everybody understands shall we?

Copyright is mostly an economic right. What it does is make sure that you the original creator profit by preventing other people from profiting from your ideas. This is why Himaruya-san doesn't care if we make fanwork. We aren't making money off it. In most countries copyright has to be registered but some countries grant you copyright automatically.

Copyright infringement is when you reproduce a copyrighted work in full or in part without permission. Period. It doesn't even matter if you claim it as your own or not. The reason we aren't all being sued is because we have implied permission from Himaruya-san. That's how it usually works with fandom. The exception to copyright is when you are reproducing parts of copyrighted material for nonprofit informational or educational purposes.

Does hellatia have copyright? No. You can't copyright fanwork of a copyrighted work without express permission from the original creator. Is hellatia committing copyright infringement? Also no. They have Himaruya-san's implied consent to make fanwork.

I think what most of us is thinking about is plagiarism. Plagiarism is when you pass off other people's ideas as your own. You don't have to copy from copyrighted work to plagiarize. It's a good thing that you aren't plagiarizing when you credit and source properly. You don't have to ask permission.

Is OP committing copyright infringement by not asking permission? No. Hellatia has no copyright. Does OP need to ask permission? Also no. Is OP plagiarizing? Definitely no. They linked to hellatia's original post and used quotation marks. Is hellatia being pompous and arrogant by demanding that OP ask for permission? That's not for us to judge. But OP isn't committing a crime by not asking. There's absolutely nothing wrong with this prompt.

Taking fills that aren't yours from this kink meme and passing them off as you're own is definitely plagiarism though.

okay but you clearly didn't graduate, if you can't understand the difference between linking to someone's AU idea, crediting them with it, and putting quotation marks around their words and reposting someone else's writing while claiming its your own.
